A. Terms & Conditions

1. Definitions

Term Meaning
ServesFood ServesFood
Guest A natural person (consumer) or legal entity who orders food via the Platform.
Host The operator of the accommodation where the Guest is staying.
Café / Partner A partner gastronomic business offering breakfast menus.
Platform The ServesFood website or mobile application through which the Order is placed.
Order A binding request by the Guest for Café products submitted via the Platform.
Service The intermediary service provided by ServesFood, which facilitates the conclusion of a purchase contract between the Guest (or Host) and the Café.
Service Fee ServesFood’s remuneration for providing the Service, charged to the Guest (or Host) and invoiced separately from the price of the food.

2. Introductory Provisions

ServesFood operates the Platform, which enables Guests and Hosts to order breakfast from partner Cafés.

ServesFood is not the producer or supplier of the food; it acts solely as an intermediary. The purchase contract for the supply of food is concluded directly between the Guest (or Host) and the Café.

These Terms & Conditions form an integral part of the contractual relationship between ServesFood and the Guest / Host.

By using the Platform, you confirm that you are over 18 years old and have read and understood these Terms & Conditions.

3. Scope of the Service and Intermediation

Through the Platform you may:

  • Search for available Cafés,
  • Select menu items and submit an Order,
  • Pay securely for the total amount (food price + any delivery + Service Fee).

ServesFood only provides order processing and payment facilitation. It bears no responsibility for the quality, safety, or allergen content of the meals.

The Service Fee is displayed on the invoice and may amount to up to 100% of the food and delivery price.

4. Order and Contract Conclusion

An Order becomes binding once it is confirmed by the Café on the Platform (the Guest will receive a confirmation email/message).

ServesFood will send the Guest a QR code or unique reference number for order collection.

The Café may reject an Order (e.g., due to ingredient unavailability). In such a case, the Guest will receive a full refund.

5. Prices, Payments, and Invoicing

The food price is set by the Café and includes VAT according to applicable regulations if the Café is a VAT payer.

The Service Fee is the price for ServesFood’s Service and includes 21% VAT. The Guest pays the total amount online by card or another payment method available on the Platform. The payment flow is as follows:

  • The food price is remitted to the Café,
  • The Service Fee remains with ServesFood.

Invoicing:

  • The Café issues a tax document (invoice) for the food price to the Guest via the Platform;
  • ServesFood issues a tax document for the Service Fee to the Guest.

6. Delivery and Collection

The Guest may choose the “Delivery to Apartment” or “Consumption at Café” option. The Guest must be present at the selected location from 10 minutes before the agreed delivery/pick-up time until the Order is handed over.

If the Guest fails to collect the Order within this time window, no refund will be provided for the food or the Service Fee.

The delivery/pick-up time is approximate and may be affected by traffic or weather.

7. Complaints and Liability

Complaints regarding the quality or quantity of the food must be addressed directly with the Café. ServesFood will reasonably facilitate communication but bears no liability for food defects.

Complaints regarding the functionality of the Platform or incorrect payments must be submitted to ServesFood’s customer support within 24 hours of the issue arising. ServesFood is liable only for damage caused by proven breach of its contractual obligations, up to the amount of the Service Fee.

8. Order Cancellation

The Guest may cancel the Order within 30 minutes of placing it by emailing info@servesfood.com.

After 30 minutes, the Order is binding; unilateral cancellation by the Guest is not possible.

9. Platform Rights

The Guest must not reverse-engineer, copy, or automatically download Platform content. Any unlawful use may result in access being blocked.

10. Changes to the Terms

ServesFood may unilaterally amend these Terms; the new version takes effect upon publication on the Platform. You will be informed of any material changes by email.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Czech Republic. Disputes shall be resolved by the competent courts according to ServesFood’s registered office.

Consumers have the right to out-of-court dispute resolution via the Czech Trade Inspection Authority.

4. Recipients of Personal Data

  • Partner Cafés (only data necessary for meal preparation and delivery)

  • IT suppliers providing Platform hosting

5. Transfers to Third Countries

We do not transfer data outside the EU/EEA, except for services certified under the US Data Privacy Framework; otherwise, we use standard contractual clauses.

6. Retention Period

7. Data Subject Rights

  • Access to processed data

  • Objection to processing for marketing purposes (§ 7 (3) Act No. 480/2004 Coll.)
  • Complaint to the Office for Personal Data Protection (uoou.cz)

8. Automated Decision-Making and Profiling

No automated decision-making takes place that would have legal effects for you.

9. Security

We adhere to privacy-by-design and privacy-by-default principles, use TLS encryption, restrict access to systems, and conduct regular audits and penetration tests.

10. Updates to the Policy

We may update this Policy from time to time. The new version will always be published on the Platform with the effective date indicated.
